Driving while Ability Impaired (DWAI)

While a DWAI is considered a lesser offense than a DUI, Colorado has established it as a crime to drive if you are impaired by alcohol or drugs. This is known as driving while ability impaired, or DWAI. A DWAI is usually a misdemeanor in Colorado, penalties can include jail time, a fine, and community service. It is considered a DWAI in Colorado when your blood alcohol concentration is over .05, but less than Colorado’s “legal limit” of .08 for a DUI.
