With a criminal charge you can be faced with either a Misdemeanor or Felony
While misdemeanors are not as serious as a felony charge, they can still impact your life. You can face probation, jail time, substantial fines, class time, public service, parenting classes, driving classes, letters of apology and payment of restitution. These are just samples of possible outcomes if convicted of a misdemeanor.
If you are convicted of a felony charge in Colorado you can face probation (generally supervised), a community corrections sentence, or time in prison. Even if you avoid a prison or community corrections sentence and receive probation, you will likely still face other requirements such as: no consumption of alcohol, no use of illicit drugs, classes, therapy, community service and payment of restitution. These are just some of the conditions that the court may order.
A felony charge will seriously impact your life and your future. It may affect your chances of employment as future employers will be able to see your felony conviction on a background report. If you are a nurse, doctor, day care provider, teacher or in another profession that requires a license, your license may be seriously impacted.
Facing a DUI or DWAI in Colorado?
Whether this is your first offense or your third, we are here to help. Often a conviction of a DUI can carry serious implications such as: stiff fines, loss of a license or even jail time. Consulting immediately with an experienced DUI defense attorney can help. Your attorney can possibly help to reduce jail time, reduce fines, reduce number of community service hours and help you keep your license. In Colorado the legal limit for blood alcohol content (BAC) that can be in one’s system is below .08. If you have a BAC above .08 within 2 hours of driving, you may be guilty of Driving Under the Influence. However, just because the police say your blood alcohol content was above .08 doesn’t mean your case can’t be defended. All tests have a margin of error and/or human error that can be used to negotiate or even to win at trial.

Driving while Ability Impaired (DWAI)
While a DWAI is considered a lesser offense than a DUI, Colorado has established it as a crime to drive if you are impaired by alcohol or drugs. This is known as driving while ability impaired, or DWAI. A DWAI is usually a misdemeanor in Colorado, penalties can include jail time, a fine, and community service. It is considered a DWAI in Colorado when your blood alcohol concentration is over .05, but less than Colorado’s “legal limit” of .08 for a DUI. Because your convictions remain on record for the rest of your life, any additional drinking and driving violation will lead to tougher penalties than before. If you have been charged with a DWAI, trust the capable attorneys at Sanders Law Firm to present a strong defense to help you in achieving the best possible outcome.
There can be serious repercussions if you are convicted of a criminal charge or a DUI/DWAI, whether it be a misdemeanor or a felony charge. While every case is different, your chances of a better outcome will greatly improve with the help of an experienced attorney.
